workers comp

Last year I got injured at work and my doctor gave me a note to stay home for 2 weeks. My manager was calling me every few days to see if I wanted to change doctors so maybe I could return to work earlier. At one point I was getting the feeling that I better rush my healing or else. After I returned to work I asked my manager what was the problem with me being off on workers comp for 2 weeks. What can next shocked me. My manager said that the longer His employee stays on workers comp the worse the score He gets on His performance review. My manger said that He didn't agree with this part of his performance review cause He felt that there was something not morale with playing with an employees health in this way but upper management watches these things closely. Besides from this being immoral,do you know if this tactic to get you off workers comp is illegal?

Teamsters Response:

Many employers try to get their employees back to work early to avoid being penalized for out of work costs. If your doctor says you can’t work including light duties then you can’t work. A union contract would spell that out for you.

As you are currently non-union I would talk to your case officer about your situation. They may or may not be able to help you.

Info on union busting

While the right to join and form trade unions is recognized in the Universal Declaration of Human Rights (UDHR),[1] union busting actions subvert the organization and continuation of unions by sowing discord amongst union members, challenging unions via law courts, strike breaking, lockouts, violent suppression, the sponsorship of anti-union organizations, or the creation of employer-controlled trade unions.
